Samsung vs Apple

By: Tyler Kempf

In the past year Samsung and Apple have been going at it in the phone business trying to be the number one seller of smart phones. Apple as you all know is the creator of the iPod and on to the iPhone. Over the years Apple is trying to perfect their iPhone and get everybody to stay committed to them. But Samsung came out of nowhere two years ago, with the Galaxy S II which shocked the world and people felt that it was the new phone and the change they wanted. This past year Samsung and Apple both came out with their new phones. For Apple it was the iPhone 5 and for Samsung it was the Galaxy S III. The earnings for Samsung were up to an astounding amount from last year, $5.2 trillion all the way up to $29.05 trillion this was a huge increase came from the Galaxy S III. This phone was nothing that anyone had ever seen so they just had to have it. It was an iPhone and more everyone wanted it, but this huge profit did not come without question from Apple. Apple felt that Samsung copied their phone in all sorts of ways. Also when the commercials came out for the Galaxy S III, Apple felt they were targeted unfairly and their ways of creating phones were bad. They felt so disrespected they took Samsung to court. Apple tried to sue Samsung for a $422 million but failed. It also tried to get their phones shut down. As you can tell that was a failure for Apple. Because we still have Galaxy S III running. When Apple took Samsung to court this is some of what was the reason for them taking them to court.  Instead of pursuing independent product development, Samsung has chosen to slavishly copy Apple’s innovative technology, distinctive user interfaces, and elegant and distinctive product and packaging design, in violation of Apple’s valuable intellectual property rights. As alleged below in detail, Samsung has made its Galaxy phones and computer tablet work and look like Apple’s products through widespread patent and trade dress infringement. Samsung has even misappropriated Apple’s distinctive product packaging. By this action, Apple seeks to put a stop to Samsung’s illegal conduct and obtain compensation for the violations that have occurred thus far.  If you were in a Oligopoly would you do the same? Would you sue another company for supposedly stealing your software for phone?

  1. This is an interesting take on this huge controversial issue in the business world. Often times there have been patents with products, but it is difficult to do so through technology. Commonly because "one thing can be different". As an oligopoly, although it seems "selfish" to sue another company -- businesses still want to eliminate as much competition as they can. It is inevitable.

  2. I agree with Eunice. In the business world anyone can claim that the other guy is stealing their products or ideas. In the an oligopoly, it's practically impossible and completely unfair to sue another company. With so little competitors all trying to create something that fits everyone's wants phones will come out very similar.

  4. What a great topic to choose, and I'm sincerely saying that. I think that this is something that the normal person would actually want to read about because more people can connect to it. Now a days one out of ever ten people have one of the phones listed above and the fraction is still growing! Your stats were good but i would suggest that next time you place a graph or chart of some sorts to give people a visual aid, it will increase the appeal of your blogs tremendously! Overall all though pretty good Mr. Kempf.

  5. Although is a controversial topic, I believe without Samsung, Apple would be either a monopoly or nothing. Samsung is competition for Apple, which drives them to be better and better, and reduce the cost of their product for American citizens. Yes, Samsung took a few ideas from the IPhone, but didn't Apple take ideas from Microsoft and other big companies too? It goes both ways and eventually, it's time to put on the big boy pants and stop complaining about other companies coming out with better products. So what if the Galaxy S3 is better than the IPhone 5? If apple was so worried about other products being greater than theirs, they could have the IPhone 6 and be making more money from that product compared to any other phone. This is the big world and as an 18 year old, I think Apple should stop worrying about other companies and worry about themselves, because they are a great company and can do greater than what they have already.

  6. I completely agree with Jason, Apple without Samsung is like April without rain, and vice versa. The reason the United States fares so well economically is because of our competitive economy, and without these competitors driving each other, they would both "fall behind" in consumers eyes. Sure, this competition may be strenuous and stressful on both of these companies, but let's be real, the people who benefit enormously from this competition is us, the consumers.

  7. This is a topic that directly relates to most of because the majority of us has either one of these phones. Apple has major profits and has dominated this market for a long time now. Since Samsung is taking some of their customers and revenues they feel threatened, and to keep themselves at the top they are doing whatever they can to keep dominating their market which is why they took Samsung to court.
